The shared parental leave regulation will impact on employers whose employee has a baby on or after 5 April 2015 – so we are talking about employees who are pregnant now.

There will be a choice for parents to take either the normal maternity leave, shared parental leave or a mixture of both. Parents of children born or adopted from 5 April 2014 will be able to share leave and statutory pay between partners, meaning that all businesses need to adapt their policies and procedures to encompass the new rules.

You will see by looking at the ‘click throughs’ below that the legislation is not simple and enacting it may become a considerable administrative burden for employers. Premier Legal will be hosting a series of seminars between now and April next year in order to explain the idiosyncrasies of the system. Shared parental leave and pay will provide parents with the opportunity to change their leave sharing choices at least 3 times during the year all of which will increase the administrative burden for HR and payroll, so this is a significant change in the parenting policies and probably, technically and administratively, the  most significant piece of legislation that employers will have to deal with in the near future.
