Acas Pre Claim Conciliation became mandatory in May 2014. From 6th April 2014 it was a voluntary process. Acas have published their statistics which show that between 6th April 2014 and 30 September 2014 they received 37,404 notifications from employees and employers.

These numbers are extremely high compared to numbers of claims that actually reach the Employment Tribunal. Acas reports that for cases notified to them between April and June 2014 only 24% progressed to a Tribunal claim. However we must not forget that the numbers of notifications also includes calls from employers and will no doubt include calls from employees who are simply disgruntled and have no real grounds for a claim.

Do not be fooled by the statistics. Whilst numbers of claims within the Tribunals have dropped significantly and much of this is related to the implementation of Tribunal fees, you should not consider that your employees are less likely to pursue a claim. Many household insurance policies have legal expenses cover meaning that Tribunal fees and legal costs are covered and so the departing or disgruntled employee will only have to pay their excess.
