Compensation for discrimination awards is at the lowest for 10 years


The 2013 Equal Opportunities Review Survey has revealed that the average award for compensation in discrimination cases is at the lowest it has been for 10 years. Employees often think that winning an Employment Tribunal claim is like having a winning lottery ticket. This is not the case. The majority of the compensation for a dismissal related claim is based on loss of earnings. If there is a discrimination claim and this is successful then the employee will also be awarded an injury to feelings award based on how serious the discrimination was and how long it went on for. The maximum award is £30,000 and the average award is in the region of £12,000.

The burden of proof in a discrimination claim lies with the Claimant (employee or ex employee). Many discrimination claims are submitted simply in an attempt to increase the value of the claim. Discrimination claims that are lacking in merit can be struck out at an early stage in the proceedings to save the fees and time involved in a lengthy hearing and having to defend complaints with little or no merit.
